Operating terms for the Tower Rush Module platform and deliverables

1. Acceptance of Terms
By accessing or using the services provided by Tower Rush Module, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services. Continued use after we post updates constitutes acceptance of the revised language except where prohibited by mandatory rules governing your contract.
2. Eligibility
You must be at least 18 years of age to use our services, or possess legal parental or guardian consent. By using Tower Rush Module, you represent and warrant that you meet these eligibility requirements and that any company you bind has authorized you to accept commercial terms on its behalf.
3. Acceptable Use
When using our services, you agree not to:
- Engage in any unlawful, fraudulent, or malicious activities.
- Attempt to reverse engineer, decompile, or disrupt the functionality of our software or platforms.
- Harass, abuse, or harm other users or our staff.
4. Payments and Refunds
Where applicable, all payments made for Tower Rush Module products or services are securely processed. Refund requests are evaluated on a case-by-case basis in accordance with our return guidelines. We reserve the right to refuse a refund if we determine the request violates our acceptable use policy or if custom fabrication has already consumed nonrecoverable materials.
5. Disclaimers
Tower Rush Module provides its services on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the reliability, accuracy, or uninterrupted availability of our services. Field conditions, code interpretations issued by reviewing agencies, and third-party installers remain outside our direct control even when we supply documentation packages.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Tower Rush Module shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our services, even if we have been advised of the possibility of such damages. Direct damages, where allowed, are capped at the fees you paid for the specific deliverable giving rise to the claim during the twelve months preceding the event.
7. Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting to our website. Your continued use of Tower Rush Module signifies your acceptance of the updated terms unless you terminate inactive subscriptions before the effective date.
8. Intellectual property, drawings, and reuse licenses
Unless a statement of work explicitly transfers title, Tower Rush Module retains ownership of underlying parametric templates, calculation notebooks, and reusable module families. You receive a nonexclusive license to construct the quantity of units quoted for your site, to maintain them, and to create as-built documentation derived from delivered files. You may not sublicense those assets to unrelated developers for unrelated parcels without a written expansion.
Trademarks referenced in marketing collateral remain the property of their owners; no grant of trademark rights is implied by quoting compatibility with industry-standard connectors or finishes.
9. Site logistics, crane windows, and readiness checkpoints
Delivery schedules assume your team clears laydown areas, provides verified lift plans, and confirms foundation tolerances before modules ship. Delay fees may accrue if modules arrive but cannot be set due to incomplete civil work, even when the root cause sits with another contractor, because staging costs compound quickly.
Weather holds and force-majeure events pause the clock only after written notice describing the obstruction and the mitigation steps attempted. Informal chat messages do not substitute for that notice channel.
10. Confidentiality, publicity, and case-study consent
Both parties agree to protect nonpublic technical data exchanged during design reviews. Tower Rush Module may request permission to photograph completed installations for portfolio use; such permission is never assumed from a generic master services agreement and can be revoked in writing if sensitive tenants occupy the building.
If you disclose our pricing or sequencing strategies to competing fabricators without consent, we may suspend support hours until confidentiality is reaffirmed.
11. Dispute resolution and informal cure period
Before initiating formal proceedings, the parties will escalate concerns through operational contacts named in the relevant purchase order and allow at least fifteen business days for good-faith remediation. Electronic correspondence to the project inbox counts as written notice for this purpose.
If escalation fails, remedies follow the dispute clause in your executed agreement. Where no clause exists, disputes proceed under neutral arbitration rules with streamlined discovery tailored to construction deliverables.
